Data protection policy

The protection of your personal data is important to SPLIN, and we comply with applicable laws and regulations, including the GDPR.

Below we clarify how we process your personal data. 

  1. Who is protected?

Any visitor to our website, any user of our application, people who have subscribed to our newsletter, our employees, our suppliers, our applicants for vacancies and our customers. This data protection policy also applies when you come into contact with our services and products in the context of prospecting, or when you visit our factory.

  1. Who processes personal data (controller)?

SPLIN SA/NV (hereinafter "SPLIN"), with registered office in 4890 Thimister, Rue des Trois Entités 12, with company number 0403.881.472, is responsible for the processing of your personal data.

If you contact us because you wish to exercise any of your rights (see point 7), we ask you to clearly indicate which right you wish to exercise. Please be as specific as possible in exercising your rights.

  1. What personal data do we process?

Depending on your location, we collect the following personal data:

  • From customers: general identification data (such as name, title/function, address, mobile and/or landline telephone number, e-mail, assigned identification data); financial identification data (such as identification and bank account numbers); financial transactions (such as amounts that have been or are to be paid); compensations; professional activities (including the nature of the activity, the nature of the goods/services used or delivered by the person in the file, business relationships); contracts and agreements with SPLIN; any other personal data that they legitimately provide to SPLIN;
  • From prospecten: general identification data (such as name, title/function, address, mobile and/or landline telephone number, e-mail, assigned identification data); professional activities (including the nature of the activity, the nature of the goods/services used or delivered by the person in the file, business relationships); any other personal data that they legitimately provide to SPLIN;
  • For suppliers: general identification data (such as name, title/function, address, mobile and/or landline telephone number, e-mail, assigned identification data); financial identification data (such as identification and bank account numbers); financial transactions (such as amounts that have been or are to be paid); compensations; professional activities (including the nature of the activity, the nature of the goods/services used or delivered by the person in the file, business relationships); contracts and agreements with SPLIN; any other personal data that they legitimately provide to SPLIN;
  • From applicants for vacancies: all the data they communicate and legitimately provide to SPLIN (as in the CV and/or motivation letter);

  • Visitors to the website: data collected via cookies (see cookie policy);

If you provide us with personal data from a third party, such as, among others, your staff, independent collaborators, directors, representatives, customers, suppliers; then you warrant to SPLIN that you (a) have lawfully obtained such personal data from the third party and have legitimately provided it to SPLIN; (b) have provided SPLIN with personal data that is up to date; (c) have provided that person with relevant information about the existence and content of this Policy.

  1. For what purposes do we process personal data?

Personal data are processed for the following purposes:

  • Execution of the contract: Creation of a personal account; correct execution and compliance with the contract and agreements; invoicing; customer service: so that we can help you quickly in case of questions and/or trouble.

  • Personalised direct marketing: Sending personalised newsletters, offers, promotions, etc. These are analyses of your personal data. If you no longer wish to receive these communications, you can unsubscribe via the unsubscribe option provided. After that, you will no longer receive direct marketing from us regarding the communication that is no longer desired, and we will stop processing your personal data for these direct marketing purposes.

  • Direct marketing: Sending newsletters, offers, promotions, etc. If you no longer wish to receive these communications, you can unsubscribe via the unsubscribe option provided. After that, you will no longer receive direct marketing from us regarding the communication that is no longer desired, and we will stop processing your personal data for these direct marketing purposes.

  • Management of applicants for vacancies

  • Necessary for the operation of our business: to improve and optimise our services (including via cookies); to take care of and improve the website (including via cookies); to prevent abuse or inappropriate use of our services; to store personal data as evidence or to take legal action; to store personal data to record attendance at/participation in events; to send surveys so that we can use to improve our services; conduct credit checks and investigate, prevent and counter fraud.

  • General: You are not obliged to share your personal data with us, but if you do not provide us with the requested personal data, we might not be able to provide you with the requested services and/or products.

  1. On what is the processing based (legal basis)?

The processing of personal data in accordance with item 4.1 is based on the performance of the contract or is intended, at the request of the data subject, to take measures for the conclusion of the contract.

The processing of personal data in accordance with item 4.2, the processing of personal data of prospects in accordance with item 4.3 and the processing via cookies other than technical and functional cookies in accordance with item 4.5 are based on the consent of the data subject.

The processing of personal data in accordance with item 4.2 for customers and the first contact with prospects, as well as other processing of personal data in accordance with item 4.5 are based on the legitimate interest of our company (only when the legitimate interest of our company outweighs the interest of the data subjects). The interests have been explained in more detail under item 4.5.

The processing of personal data in accordance with item 4.6 takes place in order to comply with the legal obligations incumbent on our company.

  1. With whom do we share personal data?

We only provide relevant aspects of personal data to third parties if these parties are contractually linked to SPLIN or act on behalf of or as subcontractors of SPLIN. We have of course concluded agreements with these parties regarding the protection of your personal data. In the cases provided for by law, however, we are obliged to communicate certain personal data to specific authorities.

We also do not provide personal data to companies located outside the European Economic Area, unless there is an adequacy decision, standard clauses, appropriate safeguards, binding corporate rules or transfers as referred to in Article 49(1) of the GDPR.

In the event of a full or partial reorganisation, merger, division, takeover or sale of assets, we are entitled to transfer the personal data to the third party in question.

  1. How long do we keep personal data (retention period)?

We only store personal data for as long as necessary to carry out the purposes set out above. Since the retention period depends on the purpose, but also on the type of personal data, the retention periods vary.

  1. What are your rights?

  • Right of access

You have the right to access your personal data. If you request so, we will provide you with a copy of the personal data processed.

  • Right of rectification

You have the right to have incorrect or incomplete personal data adjusted.

  • Right to erasure

You have the right to request SPLIN to delete your data in the cases provided for in Article 17(1) of the GDPR, for example if you withdraw your consent or object to processing for direct marketing purposes.

In this case, SPLIN will delete your data without delay, unless Article 17(3) of the GDPR  applies. For instance, SPLIN shall not delete your personal data if this is necessary in the context of compliance with a legal obligation.

  • Right to restriction of processing concerning you

You have the right to restrict processing in the cases provided for in Article 18(1) of the GDPR, for example: if the accuracy of the personal data is disputed.

  • Right to data portability

You have the right to request that the personal data you have provided yourself to SPLIN be handed over to you or to have them transferred to another company.

  • Right to withdraw your consent

You have the right to withdraw your consent at any time. The withdrawal of your consent does not affect the lawfulness of the processing based on consent before its withdrawal.

  • Right to lodge a complaint with the supervisory authority

If you do not agree with SPLIN's position, if you have any comments regarding the exercise of your rights, or if you believe that the processing of your personal data would not take place in accordance with the legislation, including the GDPR, you may submit a complaint to the competent supervisory authority to this effect.

  • Right to object to processing

You always have the right to object to processing for direct marketing purposes. In practice, you can do this via the unsubscribe option provided. After that, you will no longer receive direct marketing from us regarding the communication no longer desired, and we will stop processing your personal data for these direct marketing purposes. 

It goes without saying, however, that we may contact you if necessary, regarding the performance of the contract.

In addition, you always have the right to object to processing based on Article 6, paragraph 1, (e) or (f) of the RGPD.
